The protection of your personal data is of particular concern to us. We therefore process your data exclusively on the basis of the legal provisions (DSGVO, TKG 2003). In this data protection information, we inform you about the most important aspects of data processing within the framework of our website.

 

Use of server data

Our website can generally be visited without registration. Data such as pages called up or names of files called up, date and time are stored on the server for statistical purposes without this data being directly related to your person.

This anonymous data does not allow any conclusions to be drawn about a specific person. They are analysed for statistical purposes in order to optimise our website and our offers. We process this data on the basis of legitimate interest in accordance with Art 6 Para 1 lit f DSGVO.

Our website uses so-called cookies. These are small text files that are stored on your end device with the help of the browser. They do not cause any damage.

We use cookies to make our offer user-friendly. These are mostly so-called “session cookies”, which are deleted again after the end of your visit. Some cookies remain stored on your terminal device until you delete them. They enable us to recognise your browser on your next visit.

Our website uses functions of the web analysis service Google Analytics of Google Ireland Limited.

Google Analytics uses so-called cookies for pseudonymised range measurement, which are transferred to the user’s browser either from our server or the server of a third party. The use of cookies serves to increase the user-friendliness and security of this website.

This recognition is based on the IP address stored in the cookies. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. The information obtained in this way is used to optimise our offers and to provide you with easier access to our site.

The data processing is carried out on the basis of the legal provisions of § 96 para 3 TKG as well as Art 6 para 1 lit a (consent) and/or f (legitimate interest) of the DSGVO. Our concern in terms of the DSGVO (legitimate interest) is the improvement of our offer and our website. Since the privacy of our users is important to us, the user data is pseudonymised.

Within our online offer, the so-called “Facebook pixel” of the social network Facebook (Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland) is used due to the interest in analysis and optimisation. The code implemented on this page can evaluate the behaviour of visitors. With the help of the Facebook pixel, it is possible for Facebook to determine the visitors to our offer as a target group for the display of advertisements, so-called “Facebook ads”. The collected data is not visible to us, but can only be used in the context of ad placements.

 

Online presence in social media

We are present on social platforms Facebook, LinkedIn and YouTube in order to be able to communicate with users who are also active there and to inform them about our services there. When calling up the respective platform, the terms and conditions and data processing guidelines of the respective platform operators apply exclusively.

 

Facebook – Competitions

All competitions are in no way connected to Facebook. With their participation, all participants accept our data protection regulations and conditions of participation. Anyone who has reached the age of 18 and is resident in Austria is eligible to enter the competition. Employees of the entire HIRSCH Servo AG and affiliated companies are excluded. Participation with fake identities or with identities of third parties is not permitted. The winners will be selected at random from all eligible participants within one week of the closing date and notified via Facebook Messenger. Only 1 prize is possible per participant. The participant guarantees to be the owner of the necessary rights to the uploaded or linked photos. If the participant is not the sole author or rights holder, he/she expressly declares that he/she has the rights required for participation in the competition. The participant grants us the following simple, temporally and spatially unlimited but non-exclusive rights of use to the photo used by him/her. If the participant uploads photos, the participant guarantees that he/she will not send any content whose provision, publication or use violates applicable law or the rights of third parties. The participant indemnifies us against claims of third parties of any kind whatsoever resulting from the illegality of photos used by the participant. The indemnity obligation also includes the obligation to fully indemnify the organiser from legal defence costs (e.g. court costs and lawyers’ fees). By participating in the competition, the participant releases Facebook from any liability. We reserve the right to prematurely terminate the competition in whole or in part at any time, even without observing any deadlines, or to change its course if it is not possible to guarantee proper implementation of the competition for technical reasons (e.g. computer virus, manipulation of or errors in software/hardware) or legal reasons (e.g. prohibition by Facebook). We are responsible for the collection, processing and use of participants’ personal data, insofar as we process this ourselves. We will only use the participant’s personal information and other personal data within the framework of the statutory provisions of data protection law. We will only store, process and use the information to the extent that this is necessary for the implementation of the competition or if the participant has given his/her consent. This also includes use for exercising the rights of use granted. The data will only be used to carry out the competition and will then be deleted. Austrian law shall apply. Legal recourse to review the draw is excluded.

 

Newsletter

You have the possibility to subscribe to our newsletter via our website. For this we need your e-mail address and your declaration that you agree to receive the newsletter.

As soon as you have registered for the newsletter, we will send you a confirmation e-mail with a link to confirm your registration. This confirmation is necessary so that no one can register with other people’s e-mail addresses.

You can cancel your subscription to the newsletter at any time. If you contact us by e-mail, the data you provide will be stored on our server for the purpose of processing your enquiry. We only forward these enquiries via e-mail to those employees who need them to deal with your enquiry.

 

Your rights

In principle, you are entitled to the rights of information, correction, deletion, restriction, data transferability, revocation and objection in accordance with the requirements of data protection law. If you believe that the processing of your data violates data protection law or that your data protection rights have been violated in any other way, you can complain to the supervisory authority.
